Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice is provided by the licensed clinicians who treat you through New Tides and by New Tides Health LLC, which supports your care and handles your protected health information (“PHI”) on their behalf. We are required by the U.S. Health Insurance Portability and Accountability Act (“HIPAA”) to protect the privacy of your PHI, to give you this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.

1. How we may use and disclose your PHI without your authorization

We may use and disclose your PHI for the following purposes:

Treatment: to provide, coordinate, and manage your care — for example, so your provider can review your intake and prescribe, and so we can transmit your prescription to the dispensing pharmacy or your orders to a laboratory.
Payment: to obtain payment for the services provided to you, including verifying eligibility and processing your subscription.
Health care operations: for limited internal operations such as quality review, provider oversight, and improving the safety of our services.
Business associates: we may share PHI with vendors that perform services for us (for example, hosting, e-prescribing, laboratory, video-visit, and communications providers) only under a written HIPAA business associate agreement requiring them to safeguard it.
Appointment reminders and care communications: to contact you about your care, prescriptions, and follow-ups.
As required or permitted by law: including for public health activities, to report abuse or neglect, for health oversight, in judicial or administrative proceedings, for law enforcement as permitted by law, to avert a serious threat to health or safety, for specialized government functions, and for workers’ compensation as authorized by law.

2. Uses and disclosures that require your written authorization

Most uses and disclosures not described above will be made only with your written authorization. In particular, we will not sell your PHI, use or disclose it for marketing, or disclose psychotherapy notes (if any) without your authorization. You may revoke an authorization in writing at any time, except to the extent we have already relied on it.

3. Your rights regarding your PHI

Access: you may inspect and obtain a copy of your PHI that we maintain, in the form and format you request when readily producible.
Amendment: you may request that we correct PHI you believe is inaccurate or incomplete.
Accounting of disclosures: you may request a list of certain disclosures we have made of your PHI.
Restrictions: you may request that we limit how we use or disclose your PHI. We will consider, but are not required to agree to, all restrictions except where the law requires us to agree.
Confidential communications: you may ask us to communicate with you in a specific way or at a specific location.
Paper or electronic copy of this Notice: you may request a copy of this Notice at any time.
Breach notification: you have the right to be notified following a breach of your unsecured PHI.

4. Our duties

We are required to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, to abide by the terms of the Notice currently in effect, and to notify you if a breach of your unsecured PHI occurs. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any we receive in the future. The current Notice will always be posted on our website with its effective date.

5. How to file a complaint

If you believe your privacy rights have been violated, you may file a complaint with us at privacy@newtides.com and with the U.S. Department of Health and Human Services, Office for Civil Rights (200 Independence Avenue SW, Washington, D.C. 20201; www.hhs.gov/ocr). We will not retaliate against you for filing a complaint.
